Terms & Conditions

These terms explain the rules for the ActuallyTho iOS app, website, and waitlist.

By using ActuallyTho, you agree to these terms. If you do not agree, do not use ActuallyTho.

1. About ActuallyTho

ActuallyTho helps people stop saving things they never do. Its core flow is Save -> Commit -> Reminder -> Action -> Review.

The current product is a native, local-first iOS MVP with a main app, share extension, and widget. It does not currently require an ActuallyTho user account or offer hosted sync, a public feed, or social features.

2. Who can use ActuallyTho

You may use ActuallyTho if you are legally able to agree to these terms. If you need a parent or guardian's permission under the law where you live, you must obtain it before using the app or website.

You agree to use ActuallyTho only for lawful purposes.

3. Using ActuallyTho

You must not use ActuallyTho to break the law, harm others, interfere with the app or website, attempt unauthorised access, distribute malware, spam or overload the service, or infringe another person's rights.

  • Do not use the app or website in a way that disrupts its security or operation
  • Do not reverse engineer, copy, or exploit the product except where the law expressly permits it
  • Do not use saved material in a way that infringes copyright or other rights

4. Content you save

You are responsible for the links, notes, commitments, reflections, and other information you add. You keep ownership of your content.

Current app content is stored locally to provide app features. We do not claim ownership of it, and these terms do not give us a licence to host or publish your private saved content.

5. Reminders and notifications

Commitment reminders are scheduled locally through iOS, subject to your device settings and permissions. The share extension may also schedule a generic local reminder when permission is already granted.

We cannot guarantee that every reminder will arrive exactly on time or without interruption. You remain responsible for your commitments even if a reminder is delayed, missed, or not delivered.

6. Optional link previews and external content

If you turn on Load link details, the app may request public preview information from the saved website or, for eligible TikTok links, TikTok's public oEmbed service. The destination's own terms and privacy notice apply.

We do not control external websites, apps, articles, videos, or other content and are not responsible for their accuracy, availability, safety, legality, privacy practices, or any harm caused by using them. Saving a link does not mean we endorse it.

7. No guarantee of results

ActuallyTho provides structure to help you take action, but we do not guarantee productivity, discipline, success, consistency, or any other result.

Your results depend on your choices and actions.

8. Availability and device data

We aim to keep ActuallyTho working properly, but do not guarantee that the app, website, waitlist, or every feature will always be available, error-free, secure, or uninterrupted.

Local data can be affected by device loss, operating-system behavior, app removal, storage failure, updates, or bugs. You are responsible for managing your device and any backups available through its operating system.

9. Beta and waitlist

ActuallyTho is an early product and may be offered through a beta or waitlist. Features may be unfinished, experimental, changed, or removed, and the app may contain bugs or limitations.

Joining the waitlist does not guarantee access or a particular release date. If you provide feedback, you allow us to use it to improve ActuallyTho without compensation, but you keep ownership of any rights the law says cannot be transferred this way.

10. Third-party services

The public website and waitlist use Cloudflare hosting and D1 storage. Optional app previews contact the destination website or TikTok as described above. iOS provides local notifications, device authentication, widgets, extensions, and operating-system storage behavior.

Third-party services are subject to their own terms. We are not responsible for their availability or acts outside our control.

11. Intellectual property

ActuallyTho's name, branding, design, code, interface, and original content belong to us or our licensors.

You may use ActuallyTho only as intended through the app and website. You may not copy, reproduce, sell, modify, distribute, or create a competing product from protected parts of ActuallyTho without written permission, except where the law permits it.

12. Privacy

Our Privacy Notice explains how the local-first iOS app, website waitlist, and support communications handle information.

Privacy Notice

13. Deleting local app data and stopping use

You may stop using ActuallyTho at any time. ActuallyTho Settings includes an action to clear the app's local data and related ActuallyTho notifications.

Because the current app has no ActuallyTho user account, there is no account to close. Clearing local app data does not remove a website waitlist record, a support email, destination-site records, hosting logs, or operating-system backups. Contact us separately about information held through the website or support.

14. Restricting access

We may block or restrict access to website services, beta distribution, or future releases if you break these terms, misuse ActuallyTho, create a security or legal risk, or if we discontinue the service.

This does not remotely remove private app content stored only on your device.

15. Limitation of liability

Nothing in these terms excludes liability that cannot legally be excluded. To the fullest extent the law permits, ActuallyTho and its owner are not liable for indirect or consequential loss arising from use of the product.

  • Loss of local data, profits, business, or opportunities
  • Missed reminders or productivity losses
  • Downtime, third-party outages, or external content
  • Decisions or actions based on saved content, commitments, reminders, or reviews

ActuallyTho is provided on an as-is and as-available basis.

16. Changes to ActuallyTho

We may update, redesign, limit, pause, or remove parts of ActuallyTho while it develops. We may also stop offering the product or a feature.

Where reasonable, we will try to give notice of major changes that materially affect users.

17. Changes to these terms

We may update these terms from time to time. The updated terms will be posted here with a new last-updated date.

Where appropriate, we may provide additional notice through the app, website, or email. Continuing to use ActuallyTho after revised terms take effect means you accept them.

18. Governing law

These terms are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, except where consumer law gives you the right to bring a claim elsewhere.
